This privacy policy sets out the standards you can expect from Stennett & Stennett Solicitors ( “we”, “us”, and / or “our”) when we request or hold personal information (‘personal data’) about you how you can request access to a copy of your personal data; and the procedure to follow if you think the standards are not being met.  

Our Privacy Policy is in accordance with the Data Protection Act 2018 and the General Data Protection Regulation (GDPR), this Data & Privacy Notice explains, in detail, the types of personal data we may collect about you when you interact with us. It also explains how we'll store and handle that data and keep it safe.

Contractual obligations The main purpose for our holding your data is to provide you with legal services under the agreement we have with you. This agreement is a contract between us and the law allows us to process your data for the purposes of performing a contract (or for the steps necessary to enter in to a contract).

Legitimate Interests: In specific situations, we require your data to pursue our legitimate interests in a way which might reasonably be expected as part of running our business and which does not materially impact your rights, freedom or interests. This may include to satisfy our external quality auditors or our Regulators.

Legal compliance: If the law requires us to, we may need to collect and process your data. For example, we can pass on details of people involved in fraud or other criminal activity.

Consent: In some situations, we can collect and process your data with your consent. For example, when you tick a box to receive email newsletters. When collecting your personal data, we'll always make clear to you which data is necessary in connection with a particular service.

We also use data to communicate with our regulators or legislators and to obey laws, regulations and codes of conduct that apply to us.

How do we protect your data?
We take protecting your data very seriously. We recognise that your information is valuable, and we take all reasonable measures to protect this information whilst it is in our care.. The data you give us may be subject to Legal Professional Privilege and is often extremely sensitive and confidential.  With this in mind we will treat your data with the utmost care and take all appropriate steps to protect it. We have clear data protection and information security policies and procedures in place (along with Regulatory and other legal obligations to keep your data safe) and these are regularly assessed as part of our Quality Standards and compliance processes.  We are Cyber Security accredited and we protect our IT system from Cyber Attack with exceptional standards of technology and operational security to protect personally identifiable data from loss, misuse, alteration or destruction. Similarly, we adopt a high threshold when it comes to confidentiality obligations and both internal and external parties have agreed to protect confidentiality of all information; to ensure all personal data is handled and processed in line with our stringent confidentiality and data protection policies. Access to your personal data is password-protected, and sensitive data is secured by encryption.  We regularly monitor our system for possible vulnerabilities and attacks and wed carry out penetration testing to identify ways to further strengthen security.

Retention Period of Personal Information:

Your personal data will be stored securely for 12 years from the date, we close your file or longer as we are required either contractually or under our regulatory obligations after which your personal data will be permanently and securely deleted and destroyed. You can contact our admin team at enquiries@stennett-stennett.co.uk for more information or should you require us to destroy your personal data earlier than this date. However, this may mean that our service cannot be provided in full.

The personal data which we collect will be collected as it is necessary for us to carry out our service which will ordinarily be to represent you and carry out your legal work. If you provide us with any personal data, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of Stennett & Stennett Solicitors.  

If you do not agree to voluntary provide this information, we may not be able to advise or represent you.  

Website or third party sources.
We collect certain related technical information including, but not limited to, traffic data, location data, logs (including, where available, the IP address and location of the device connecting to the online services and other technical information and identifiers about the device and the nature of the visit such as clickstream to, through and from our website) and other communication data, and the resources that you use.  On occasions, we acquire information from other companies, to collect information about how visitors to our website use the site. Information is also collected about how you arrived at our websites in the first place, including what links or adverts you have viewed or clicked on to reach us, or any search terms you have used. We do this to maintain and improve our website, getting a better understanding of visitor and client profiles and ultimately delivering a better experience. We have a data protection regime in place to oversee the effective and secure processing of your personal data.  Generally, we will only use your information within Stennett and Stennett Solicitors. However, there may be circumstances, in carrying out your legal work, where we may need to disclose some information to third parties; for example:

  • HM Land Registry to register a property;
  • A Court or Tribunal;
  • Solicitors acting on the other side;
  • Asking an independent Barrister or Counsel for advice; or to represent you;
  • Non legal experts to obtain advice or assistance;

  • External auditors or our Regulator; e.g., Lexcel, SRA, ICO etc.;

  • Insurance Companies;
  • Providers of identity verification;
  • Any disclosure required by law or regulation; such as the prevention of financial crime and terrorism and
  • If there is an emergency and we think you or others are at risk
In the event any of your information is shared with the aforementioned third parties, we ensure that they comply, strictly and confidentially, with our instructions and they do not use your personal information for their own purposes unless you have explicitly consented to them doing so.

Third Party Data and Sharing
Stennett and Stennett Solicitors does not directly share your personal information with anyone else. Our ICT service providers have access to our servers and can therefore access personal data. They are contractually appointed to provide a service to us and need access to our data in order to protect the storage of any personal data.

Decision making
There is not currently any automated decision making or logic involved when accepting or rejecting referrals. All decision making is currently done by human intervention.

We may update this policy from time to time by publishing a new version on our website.  We last updated this Policy in 2024. You should check this Policy to ensure you are happy with any changes.  We will not update you with all changes, but significant changes will be notified via email.
